AGREEMENT TO DISPLAY
In this Agreement, Artlicity grants the SUBSCRIBER the right to display mutually agreed upon canvas artwork. The subscription and terms and conditions shall be determined by Artlicity and shall be agreed upon by the Subscriber. The Subscriber also agrees to display name plaques under each painting that will list the name of the painting and where a customer/client can purchase said painting
PROCEEDS AND TERMS OF SUBSCRIPTON SERVICE
The Subscriber shall choose a Service Package. The Subscriber shall submit the monthly payment according to the subscription terms, to Artlicity by the 25th day of each month. The Subscriber can also choose to pay in a collective sum quarterly or yearly. The first payment will be due within 30 days of signing this agreement. Payment must be made prior to installation. Upon payment, an installation date will be scheduled. The Subscriber agrees to maintain the agreed upon subscription cost and will abide unless otherwise agreed upon in writing and signed by both parties. The Subscriber shall retain possession of the subscribed merchandise for a minimum of 365 days, beginning on the agreement date. Artlicity agrees to change out the merchandise every quarter. Prior to or upon delivery of the merchandise, Artlicity shall provide a complete and accurate inventory list of the merchandise items that have been subscribed. This list must include a description of each item, the quantity of each item, and the retail price of each item, and it must be acknowledged by both Artlicity and The Subscriber upon acceptance. The merchandise will be professionally evaluated by Artlicity for any damage prior to delivery, which will be recorded by Artlicity. All subscribed merchandise shall remain at the Subscriber address and shall not be moved to another location without prior written notice to Artlicity Authorized Agent.
MERCHANDISE OWNERSHIP
Artlicity shall retain ownership of any and all merchandise.
MERCHANDISE PURCHASING
The Subscriber and its employees will receive a 5% discount for any painting they wish to purchase through the website. The discount is ONLY for The Subscriber and its employees. If a customer/client of The Subscriber wants to purchase one of these artworks they DO NOT receive a discount.
BREACH OF AGREEMENT
If the Subscriber fails to perform and/ or adhere to the terms and obligations contained herein this Agreement, Artlicity will automatically charge The Subscriber a collective total of 6 months of monthly charges
LIABILITY FOR LOSS, DAMAGE OR THEFT OF SUBSCRIBED MERCHANDISE
The Subscriber shall maintain insurance for the premises and all contents thereof against any damage or theft that may occur to any item(s) left with the Subscriber. If damage, theft, or any of the above stated occurs, the Subscriber, must pay for the artwork piece IN FULL within 30 days following the loss of the merchandise.
We conduct a wall sample test before we do any installation. If your wall does not pass this test the “damage free” installation may not be an option for you. You may have the following cases happen if your walls do not pass the test; small nail holes, dry wall anchors, paint blemishes.
Upon damage free installation, in rare cases, some paint/wall damage may occur.
WARRANTIES
Neither the Subscriber nor Artlicity shall make any guarantee or warranties in relation to any sale, use, or transfer of the merchandise by the other party or any third party acting on behalf of the Subscriber or Artlicity.
PRICING AND PAYMENT
The Subscriber has agreed upon paying the amount of USD x , for the . Contents and Inventory of this package will be listed on a separate document. The Subscriber has agreed to pay the said amount on a basis.
